Overview: Where defendant waived his right to a jury on the elements of aggravated incest under Colo. Rev. Stat. § 18-6-302(1), he pleaded guilty to the offense and an added count of child abuse; the trial court did not violate his constitutional rights by using his admissions to impose an aggravated sentence of twenty-five years in prison for child abuse.
