Overview: In response to a certified question of the United States Court of Appeals for the Tenth Circuit, the procedural requirements for perfecting a lien contained in Colo. Rev. Stat. §§ 38-22-109 and 110 did not apply to claims by material suppliers against money held in trust under the Mechanics Lien Trust Fund Statute, Colo. Rev. Stat. § 38-22-127.

Overview: Defendant's sentence for two class four felony sex offenses of consecutive indeterminate terms of 25 years to life under Colo. Rev. Stat. § 18-1.3-1004 was improper because it exceeded statutory limitations in that the sentences were more than twice the maximum sentence in the presumptive range as required by Colo. Rev. Stat. § 18-1.3-401.
