Overview: Where plaintiff was injured while attending a movie in defendant's theater, the trial court properly dismissed his claim against defendant for negligent breach of contract pursuant to Colo. R. Civ. P. 12(b)(5). The Colorado Premises Liability Act, Colo. Rev. Stat. ¿ 1321115 (2004), was plaintiff's exclusive remedy and the claim was time-barred.
