Overview: Where a provider anticipatorily repudiated its obligation to pay present and future royalties to a consultant pursuant to an agreement, the jury could award future damages based on royalties because, inter alia, the evidence of future royalties was not too speculative; however, the award was reduced based on evidence of the unit production cost.
