Overview: Under Colo. Rev. Stat. § 24-10-103(5), trial court erred in determining that insurer was "public entity" and that it was entitled to immunity under Colorado Governmental Immunity Act, Colo. Rev. Stat. §§ 24-10-101 to -120. Status as private corporation, even though it entered a contract with a public entity, precluded treatment as public entity.
