Overview: Although an arresting officer improperly permitted a motorist to take a breath test after the motorist had initially chosen and then refused to take a blood test, the officer's violation of Colorado's express consent statute, Colo. Overview: Trial court did not abuse its discretion in determining that a bailment had been created with respect to the wife's jewelry, because the husband had control of the home and thus had possession of the jewelry the wife had left, however, the case was remanded for further proceedings since there was only a presumption of negligence, not proof.
