Overview: Noneconomic damages of $ 100,000 awarded to passenger for inconvenience, emotional stress, and impairment of the quality of life were included in the meaning of "pain and suffering" under the seat belt defense provision of Colo. Rev. Stat. § 42-4-327(7) and therefore jury should have been instructed that passenger was not wearing seat belt.
