Overview: Denial of certification to appeal denial of habeas petition was not an abuse of discretion. Habeas court credited trial counsel's testimony that he was absent for a week or two and found trial counsel did not cause delay in inmate's attempt to accept plea offer that was rescinded. The appellate court would not second guess the credibility finding.
