Overview: Subcontractor was entitled to a new trial in plaintiff's negligence suit because plaintiff had knowledge of the dangerous condition which led to his injury, and that danger was open and obvious, eliminating any alleged duty to warn. Thus, it was improper for trial court to charge the jury on the failure to warn specification of negligence.
