Overview: Because both a speedy trial and a Batson claim were untimely asserted under both Del. Super. Ct. R. Crim. P. 29(c) and 33, they were properly denied. Moreover, given that defendant's alleged newly discovered evidence would not have affected the outcome of his trial, said evidence did not afford him a basis for relief.

Overview: Upon a fourth conviction for driving under the influence, defendant's fifth motion to correct an illegal sentence was properly denied pursuant to Del. Super. Ct. R. Crim. P. 35(a), as: (1) his voluntary guilty plea waived any error prior to the entry of said plea; and (2) Del. Code Ann. tit. 21, § 4177(d)(4) did not operate as an ex post facto law.
