Overview: Where a claimant was hired on a day-to-day basis and became ineligible to work as a member of the casual workforce because she failed a physical, under Del. Code Ann. tit. 19, § 3323(a), substantial evidence supported the Chief Appeals Referee's conclusion that the claimant was a casual employee and not entitled to unemployment benefits.

Overview: Since defendant made no attempt to question the court's, or any other court's, authority to decide his case, he did not avoid the procedural bar under Del Super. Ct. R. Crim. P. 61(i)(4). Nor did he offer evidence to support his claim of ineffective assistance of counsel. Thus, defendant's claims for postconviction relief were procedurally barred.
