Overview: Giving a lesser-included jury charge was correct, as assault in first degree was included in attempted murder under Del. Code Ann. tit. 11, § 206(b), and rational basis for jury charge existed as victim was shot in his extremities, not in vital areas, no intent to kill was shown, and shooting happened during general melee that was a barroom brawl.
