Overview: Inmate was not entitled to postconviction testing of DNA samples where he could not show any probability new testing would produce evidence to help show his innocence of crime charged. And, as the government noted, such testing and analysis had already been performed, and directly, and explicitly, refuted inmate's theory another committed crime.
