Stat. ch. 812.31(1) and (2)(a) (2000) and finding that he was a habitual violent offender under Fla. Stat. ch. 775.084(b)(1) (2000), such was an illegal sentence that required modification.

Florida appellate courts had uniformly interpreted Rule 1.490(h) to require a mandatory hearing before the trial court on the parties' exceptions if requested.
