Overview: Where asurety and contractor sued the latter's liability insurers, as the surety was not a named insured, an omnibus insured, the estate of an insured, the named beneficiary of a policy, and did not have a valid assignment of the contractor's rights, it was not entitled to recover counsel fees from the insurers under § 627.428, Fla. Stat. (2006).
