Overview: Inmate who dropped a concrete block on the victim's head and strangled him was sentenced to death. As photos of the victim were relevant to support the State's argument of the applicability of the heinous, atrocious, or cruel aggravator, appellate counsel was not ineffective for failing to raise a meritless claim based on admission of the photos.

Overview: Defendant was convicted of the simultaneous murders of his girlfriend, her other boyfriend, and her minor child, and was sentenced to death for the murder of the adults. It was not error to assign great weight to the burglary aggravator under § 921.141(3), Fla. Stat. (2002) as to adults and not child, as adults were defendant's targeted victims.

Overview: Denial of death row inmate's Fla. R. Crim. P. 3.851 motion was affirmed; there was no basis for disqualifying the trial court from hearing the motion, no Brady or Giglio violations had occurred in the inmate's double murder trial, and denial of leave to amend the Rule 3.851 motion was proper as the motion was not timely filed.
