Overview: Defendant was entitled to an acquittal on a charge of engaging in a scheme to defraud and organized fraud, under Fla. Stat. § 817.034(4) (2003), on double jeopardy grounds, as he could not be convicted of that crime and grand theft, when the acts constituting that crime and grand theft resulted from the same conduct, not separate criminal episodes.
