Overview: Trial court erred in denying defendant's plea of double jeopardy, refusing to allow him to call the prosecutor as a witness at the hearing on the matter, as such denied him the right to confront the witness against him, and hence, the opportunity to prove whether the prosecutor intended to goad defendant into moving for a mistrial.
