Overview: The Department of Transportation's Utility Accommodation Policy and Standards did not impose the nondelegable duties of an applicant for an utility encroachment permit upon contractors doing work for the applicant. Thus, in a personal injury suit, contractors were not liable under O.C.G.A. § 51-2-5(4) for the actions of an independent contractor.
