Overview: Where a husband was hit by a state-owned van being driven by a university professor, the university's dismissal motion of his suit, arguing that it was time-barred per Haw. Rev. State v. Hulama, NO. 26561, INTERMEDIATE COURT OF APPEALS OF HAWAI'I, March 19, 2007, Decided

Overview: Family court did not err in concluding that Haw. Rev. Stat. § 709-906(4) authorized police to issue defendant warning citation based on any past incident of physical abuse or harm because 1998 amendment to § 709-906 removed requirement that physical abuse or harm be "recent." Hence, his conviction for abuse of family or household member was upheld.

Overview: It was harmless error under Haw. R. Penal P. 52(a) for court to have excluded defendant's proffered testimony he suffered from mental illness as it did not prevent him from testifying he sometimes engaged in strange behavior thus providing context for his claimed behavior during encounter with victim to support credibility of his version of events.
