Overview: Defendant's conviction for abusing his stepdaughter in violation of Haw. Rev. Stat. § 709-906 was affirmed. Under Haw. R. Evid. 803(b)(2) the stepdaughter's statements at the scene and at an emergency room that defendant beat her for not getting into the car were admissible as excited utterances, as she was still under the stress of the assault.
