Overview: Because State employer did not consent to personal injury settlement between employee and driver, insurer, and car rental agency as required by Haw. Rev. Stat. § 386-8, the settlement was invalid. Thus, trial court properly set aside the settlement under Haw. R. Civ. P. 60(b), and the employee could not have breached an agreement that was invalid.
