Penal P. 40 was proper where Hawai'i's Paroling Authority could not lawfully postpone minimum sentence hearing until after inmate finished serving a term imposed under Haw. Rev. Stat. § 706-660.1; under Haw. Rev. Stat. § 706-669, such hearings were required to be held within inmate's first six months of incarceration.
