Overview: While forgery in third degree, contrary to Haw. Rev. Stat. § 708-853, was lesser included offense of forgery in second degree, contrary to Haw. Rev. Stat. § 708-852, court's failure to instruct jury on forgery in third degree was harmless where jury convicted defendant of forgery in second degree, which was both charged offense and greater offense.
