Overview: Court affirmed defendant's conviction of operating a vehicle under the influence of an intoxicant, Haw. Rev. Stat. § 291E-61(a)(1) (Supp. 2002), because, in part, the district court did not err in taking judicial notice of "glassy, red, watery eyes" as indicia of defendant's intoxication and there was substantial evidence to uphold the conviction.
