Overview: Pursuant to the Probate Act of 1975, 755 Ill. Comp. Stat. Ann. 5/1-1 et seq., security interests the U.S. government obtained when it issued loans to a decedent did not bar the estate's executor from using the proceeds from the sale of collateral to pay attorney fees; the government's claim was subordinate to estate administration expenses.
