Overview: Appellate court erred in finding verdicts against first defendant and second defendant were legally inconsistent under 720 Ill. Comp. Stat. Overview: Where the trial court made a sua sponte Batson challenge to defense counsel's peremptory strike of an African-American juror, although a trial court could raise a Batson issue sua sponte, the record was insufficient to demonstrate either a prima facie case of racial discrimination or the bases for the trial court's rulings.

Overview: Trial court could raise a Batson issue sua sponte but could do so only when a prima facie case of discrimination was abundantly clear. Moreover, it had to make an adequate record consisting of all relevant facts, factual findings, and articulated bases for both its finding of a prima facie case and for its ultimate determination of discrimination.

People v. Taylor, Docket No. 99756., SUPREME COURT OF ILLINOIS, May 18, 2006, Opinion Filed
View this case - free

Overview: Reversal of a juvenile's conviction under 720 Ill. Comp. Stat. Ann. 5/31-6(a) (1998) was affirmed. The juvenile's prior delinquency adjudication, related to a robbery, did not make him a "person convicted of a felony" as required by the statute as delinquency adjudications were not "convictions."
