Overview: In a malpractice action, the jury had a sufficient basis to find that a patient was justified in believing that a physician was employed by a hospital and that the hospital was liable because the physician was its apparent agent. Nothing in the hospital's treatment consent form alerted the patient that the physician was an independent contractor.
