Overview: In an Ind. R. Trial P. 60.5 mandate action, salary ranges for court employees of contiguous counties were the most useful benchmark for determining what the salaries in Montgomery County should be. As the mandated salaries exceeded both the means and the medians of the salary ranges, salaries were to be increased, but not in the amounts requested.

Overview: Order granting of motion of purchaser of property at a tax sale for refund of the purchase price minus a 25 percent penalty was improper because Ind. Code § 6-1.1-25-4.6(d) allowed a refund only where petition for a tax deed was filed and trial court refused issuance of the deed, and purchaser never tried to issue the second notice required.
