Overview: It was error to dismiss a charge against a defendant who had been found incompetent to stand trial under Ind. Code § 35-36-3-1 and involuntarily committed under Ind. Code ch. 12-26-7 because she had been committed for longer than the maximum sentence. There was no authority for equating time in involuntary commitment to credit for time served.
