COURT OF APPEALS OF IOWA, June 28, 2006, Filed

Overview: Because defendant admitted that he knew all along about his niece's scheme to use another person's Medicaid card, a factual basis existed to support his plea of guilty to second-degree fraudulent practice, Iowa Code §§ 249A.8, 714.8, 714.10, and 703.1 (2005), and defense counsel was not ineffective for failing to challenge the plea.

Overview: Court properly modified child custody to a father, Iowa Code § 598.21, because the mother secretly moved the child to California, the father regularly exercised his visitation, he participated in the child's activities, and the father demonstrated a greater interest and ability to support the mother's relationship with the child.
