Overview: Where a trustee paid himself compensation for the first time after 12 years of service, the payment was not a breach of loyalty voidable under Kan. Stat. Ann. § 58a-802, but judgment against the beneficiary at the close of evidence was improper under Kan. Stat. Ann. § 60-252(c) because there was some evidence of waiver of the right to compensation.

Overview: When the officer arrested defendant for DUI, he read an outdated implied consent advisory DC-70 form. The Court of Appeals of Kansas held that the officer's implied consent advisory did not fulfill the notice requirements of Kan. Stat. Ann. § 8-1001(f); therefore, defendant was entitled to suppress evidence of the breath test.
