COURT OF APPEALS OF KENTUCKY, May 11, 2007, Rendered

Overview: Denial of a father's motion to modify visitation for lack of jurisdiction was improper because, under Ky. Rev. Stat. Ann. § 403.824, Kentucky had exclusive, continuing jurisdiction, despite the fact that one child lived in Kentucky and two lived in Tennessee. Among other things, both prior custody orders were entered by Kentucky courts.
