Overview: Agreement requiring mediation of workers' compensation claims did not violate employee's rights under Ky. Rev. Stat. Ann. § 342.277(3), as she knew of ADR program, had ample time to obtain advice from counsel as to her rights, and, as she continued in her job after her union agreed to ADR provision, she was deemed to have consented to it.
