Overview: A judgment dismissing a deceased individual's action to set aside a deed for failure to revive the action under Ky. Rev. Stat. Ann. § 395.278 was vacated where the individual's action had been submitted to the trial court for judgment before the individual's death and thus, revival was not required for the daughter to continue the case.
