Overview: A trial court erred in withholding from the jury the legal determination of whether a revolver defendant brandished during a robbery was a "deadly weapon" under Ky. Rev. Stat. Ann. § 515.020, but the error was harmless because, had the jury been properly instructed, there is little doubt it would have found the gun to be a deadly weapon.
