Overview: Kentucky Parole Board's reliance on 501 Ky. Admin. Regs. 1:030(3)(f) (2003), rather than on 501 Ky. Admin. Regs. 1:011 (1983), the latter of which was in effect at the time that an inmate committed his crimes, was not a violation of ex post facto, as the inmate's punishment was not enhanced or elongated by reliance on the newer rule.
