Overview: Summary judgment granted in favor of the bank for a right of set-off in funds held by the debtor in a commercial deposit account with the bank was affirmed because the bank had a superior right to the funds pursuant to Ky. Rev. Stat. Ann. § 355.9-340 absent an agreement between the creditor and the bank under Ky. Rev. Stat. Ann. § 355.9-104.

Overview: Because an injured worker was aware of the work-related nature of his injury more than two years prior to making his claim, and he did not argue that he suffered any additional work-related trauma, substantial evidence supported the ALJ's finding that the claim was untimely under Ky.
