Overview: Defendant's conviction for aggravated rape under La. Rev. Stat. Ann. § 14:42(A) was supported by sufficient evidence that showed any discrepancies in victim's account of the rape at knife point were not so material as to call her version into question, and defendant's version of the victim's attempted suicide was not credible in light of evidence.

Overview: Defendant's conviction had elements of both La. Rev. Stat. Ann. §§ 14:64 (armed robbery) and 14:64.3 (use of firearm in robbery). However, jury convicted him of single crime of being a principal to the crime of armed robbery with the use of a firearm and the judge sentenced him for that single offense. Thus, there was no double jeopardy violation.

Overview: Sufficient evidence supported defendant's conviction for possession of a firearm by convicted felon and assault by discharge of firearm under La. Rev. Stat. Ann. §§ 14:95.1 and 14:37.4 where eyewitnesses testified that fist fight had ended and that victim did not pose further threat to defendant when defendant pulled out a gun and started firing.

Overview: Defendant was adjudicated second felony offender and evidence showed he robbed clerk at gunpoint with threat of great bodily harm, and he then proceeded to drag her into a back room. He had not benefitted from prior rehabilitative efforts and his sentence of 99 years for armed robbery with firearm was not excessive or grossly disproportionate.
