Overview: Parents, on behalf of minor child, brought a medical malpractice suit against a physician and other defendants. Intermediate appellate court erred in declaring La. Rev. Stat. Ann. § 40:1299.42(B) violated La. Const. art. I, § 22 because issue was never briefed or argued before trial court, and issue was not relied upon in summary judgment motion.
