Overview: Court did not err in finding employees were unable to support claim under intentional act exception to workers' compensation statute found in La. Rev. Stat. Ann. § 23:1032(B), as they had not presented facts raising genuine dispute employer desired they be exposed to asbestos but court erred in finding employer's insurer did not owe duty to defend.

Overview: Court erred in finding insured's material misrepresentations regarding her uninsurable sister's use of car were not material to insured risk, i.e., theft, and did not void contract; insured made misrepresentations with intent to deceive and misrepresentations materially affected risk assumed thus under La. Rev. Stat. Ann. § 22:619, policy was void.
