Ann. art. 578(2) was reversed because he State and the defense extended the date of prescription when they agreed to a trial date beyond the date the prosecution would have prescribed.

Overview: After being acquitted of aggravated burglary, court of appeal erred in vacating verdict in second trial of unauthorized entry of inhabited dwelling, as being unresponsive to charge it believed should have been brought, i.e., attempted aggravated burglary but, verdict was not inherently tainted by its return in a trial of a jeopardy-barred offense.

Overview: Once church's planes were imported and hangared in Louisiana, they were withdrawn from interstate commerce; therefore, Louisiana's tax on storage and use was effective. La. Rev. Stat. Ann. § 47:305(E) taxed planes since they came to rest in Louisiana. Ascension Parish did not have authority to impose use tax as taxable moment did not occur there.
