Overview: Defendant's sentence of 45 years at hard labor for armed robbery in violation of La. Rev. Stat. Ann. §§ 14:64, 14:64.3 was affirmed because defendant received a significant benefit through a plea bargain that prevented the State form charging him as a habitual offender and he was on probation for prior felonies when he committed the robbery.

Overview: Defendant's convictions and sentences for two counts of armed robbery in violation of La. Rev. Stat. Ann. §§ 14:64, 64.3 were affirmed. Defendant planned the robbery of a restaurant and procured the gun, and defendant did nothing to stop an accomplice from robbing a customer. The 25-year sentences were not grossly disproportionate to the crimes.

Overview: Although claimant suffered a work-related injury, she did not carry her burden of proof as to entitlement to La. Rev. Stat. Ann. §. 23:1221(3)(a) SEBs and court erred in awarding them because claimant was released by her doctors to perform sedentary work on a full time basis and the employer in fact offered her 40 hours of sedentary work per week.
