Overview: In a wrongful death suit, nurse's motion for summary judgment under Mass. R. Civ. P. 56(c) was denied because there was a genuine issue of fact as to whether nurse, as employee of state medical center which merged with a private entity, was a public employee--and thus immune from suit under Mass.
