Overview: Because the Michigan Department of Community Health (MDCH) was a health oversight agency, and the requested information pertained to the MDCH's oversight activities authorized by law, the dentist, as a health care provider under 42 U.S.C.S. § 1320d(3), was authorized to release the information under HIPAA regulation, 45 C.F.R. § 164.512(d)(1).
