Overview: Defendant's Miss. Const. art. III, § 26 right to a speedy trial was not violated because, while delay did exist, defendant failed to assert his right to speedy trial, did not object to any delays, other than filing day before trial motion to dismiss for failure to provide speedy trial, and failed to show that he suffered any prejudice due to delay.

Overview: In contract dispute between county and corporation, liquidated damages that were awarded to corporation were appropriate because parties were in a position to calculate damages and amount awarded was tried by consent; however, trial court erred in not awarding prejudgment interest on unpaid contract balance pursuant to Miss. Code Ann. § 31-5-25.
