Overview: Resident only proved that one or more of the police officers were negligent in arresting the resident, which caused the city to be exempt from liability under the Mississippi Tort Claims Act, Miss. Code Ann. § 11-46-9(1)(c); the police officers did not act in reckless disregard of the safety and well-being of the resident or any other citizen.

Overview: Although dog sniff tests were entitled to probative weight in cases involving currency, and the "currency contamination theory" was rejected, a city did not meet the burden of showing that currency was subject to forfeiture under Miss.
