Overview: The trial court did not abuse its discretion in dismissing without prejudice, pursuant to Miss. R. Civ. P. 41(b), the claims of severed plaintiffs which were not properly filed in Noxubee County; the trial court's actions were in conformity with a procedure later prescribed by the supreme court whereupon plaintiffs could refile in a proper venue.
