Overview: In a possession of cocaine case, because the jury, in reliance on the State's theory and argument, might have convicted defendant based on possession of items in his wife's purse, of which there was no evidence, a miscarriage of justice occurred, Mo. Sup. Ct. R. 30.20, and therefore, the judgment was reversed and remanded for a new trial.

Overview: Pursuant to its authority under Mo. Sup. Ct. R. 84.14, the court modified the trial court's dissolution judgment to reflect a start date of May 2005 for maintenance payments, instead of May 2004, because the May 2004 date would have given an award of retroactive maintenance, which was not allowed under Mo. Rev. Stat. § 452.335.
