Overview: In defendant's assault case, a court erred by instructing the jury on intoxication, Mo. Rev. Stat. § 562.076, because he did not try to defend the charges by claiming that he was intoxicated; he consistently relied upon a theory of self-defense without every admitting any wrongful conduct, and therefore, the instruction likely confused the jury.
